1. Introduction
1.1. "Car Leasing International" Ltd., located at 27A Batak Street, 8001 Burgas, Bulgaria, tax identification number BG205364593 (hereinafter referred to as "the Company"), operates the website www.open-market.eu, which serves as a platform for publishing vehicle sale offers from legal entities and individuals ("Sellers").
1.2. The Company acts solely as an intermediary between the Buyer and the Seller and organizes the delivery of purchased vehicles. The Company is not the owner or manufacturer of the vehicles and does not provide warranties for their condition.
1.3. These General Terms and Conditions govern the relationship between the Company and the Buyer regarding the use of the website and the services offered through it. By agreeing to these General Terms and Conditions, the Buyer also accepts all policies and additional terms published on the website.
2. Warranty and Liability
2.1. The Company does not provide a warranty for the condition of the vehicles, as they are provided by the Seller. Any warranty, if available, is covered by the Seller, the Manufacturer or a relevant third party.
2.2. The Buyer confirms that all data and descriptions of the vehicles are based on information provided by the Seller, and the Company is not liable for any discrepancies.
2.3. To the maximum extent permitted by law, the Company is not liable for losses caused by inaccurate information, fraud by third parties, or other factors beyond its control.
3. Sales and Payments
3.1. The Buyer creates an order through the website and makes a payment for the listed purchase price, which includes the Company's commission, transportation costs, and VAT.
3.2. Before making a payment, the Buyer must contact a representative of the Company to confirm the availability of the selected vehicle.
3.3. The Buyer is obligated to make the full payment within 24 hours of creating the order; otherwise, the order will be canceled. Payments are made via bank transfer to the Company's account.
3.4. Upon receipt of payment, the Company organizes the purchase of the vehicle and its delivery to its dealership center in Burgas, Bulgaria.
3.5. If the Company fails to purchase the vehicle, the amount will be refunded to the Buyer within 7 business days.
4. Delivery and Handover
4.1. The vehicles, along with their accompanying documents, are delivered to the Company's dealership center in Burgas, where the Buyer can collect them in person or through an authorized representative.
4.2. The Buyer must accept the vehicle within three business days of its arrival. In case of delay, the Buyer may be charged a storage fee.
4.3. If the Buyer authorizes a third party or a transport company to receive the vehicle, the Buyer bears full responsibility for any losses, damages, or administrative penalties related to the transport.
5. Force Majeure
5.1. The Company is not liable for delays or failure to fulfill its obligations caused by force majeure circumstances, including but not limited to: natural disasters, pandemics, strikes, legal changes, economic sanctions, military conflicts, or other unforeseen circumstances beyond the Company's control.
6. Amendments and Additions
6.1. The Company reserves the right to make changes and additions to these General Terms and Conditions. All changes take effect after being published on the website.
7. Final Provisions
7.1. All notices and correspondence between the parties shall be conducted in writing via email or mail to the Company's address.
7.2. If any clause of these General Terms and Conditions is deemed invalid or unenforceable, it shall not affect the validity of the remaining clauses.
7.3. For all unregulated matters, the applicable European legislation and the legislation of the Republic of Bulgaria shall apply.
